Conditions in Which Auctions May Be Refused

 

If the Seller does NOT have the auctioned vehicle and/or cannot legally title the vehicle at the end of auction, THEN the buyer may refuse the vehicle and the Auction will be considered invalid.  The Seller will be assessed a $75 Sellers Reinstatement Fee payable immediately to the NDA.  NOTE: The Seller’s auction privileges will therein be suspended until the said fee is paid!  Two occurrences of this nature by any Seller within a year will result in the permanent suspension of the Seller from the NDA.  The Buyer will be refunded the full escrow amount (Escrow Fee and Escrow Deposit) previously submitted.

 

If the Buyer fails to submit the appropriate Deposit and Escrow Fee within 48 hours of the end-of-auction time; the Auction may be refused by the seller and the Auction considered VOID.  The Buyer will assess a $75 Buyer Reinstatement Fee payable to the NDA.  NOTE: The Buyer’s auction privileges will therein be suspended until the said fee is paid!  Two occurrences of this nature by any Buyer within a year will result in the permanent suspension of the Buyer from the NDA.  The Seller will receive a credit for the winning auction listing.

 

If the Buyer has placed the deposit for a winning auction, but fails to provide final payment to the buyer within 96 hours of deposit placement; the seller may refuse the auction item.  If the auction is refused by the Seller, the Auction will be considered abandoned and the Buyer forfeits the deposit and Escrow Fee previously submitted.  The Seller will therefore be awarded the Deposit submitted by the Buyer for item (Less the Sellers Fee for the auctioned item). 

 

If the Buyer has placed the deposit for a winning auction and the auction item is physically viewed or Test Driven by the Buyer at time of delivery AND the auction item was found to be misrepresented by Seller; the Buyer has the right to refuse the auction item prior to making the final payment to the Seller.  The auction must be refused within 96 hours of placing the deposit for the winning auction.  If the Buyer indeed refuses the auction item and grounds are founded by the NDA; then the Auction will be considered Refused.  The Buyer’s Escrow Fee is forfeited but the Deposit will be refunded (Less a $45 Buyer Cancellation Fee). The Seller will receive a credit for the winning auction listing.

 

If the Buyer has placed the deposit for a winning auction and the auction item is physically viewed or Test Driven by the Buyer AND the Buyer has made the final payment to the Seller for the Auction; the Buyer has officially  “accepted” the vehicle per the terms of the National Dealer Auction and sale is final.  Again, it is the Buyer’s responsibility to ask any decision making questions to the Seller prior to the end-of-auction time; using the Auction Item’s Question and Answers Forum.
